What is a Party Wall Notice ?

A Party Wall Notice is a letter informing your neighbour or neighbours of the proposed work(s) that you shall be carrying out. In turn your neighbour will have a few options to choose from on that notice. The majority of notices served from surveyors will usually have the same options on the notices.

 

The main options are as follows below

  • Consent – This option means that you are fine with the works to go ahead without having a surveyor in place.
  • Dissent to the notice and wish to use their own surveyor – This means that they wish to have there own surveyor in place rather than to use the same surveyor (Agreed Surveyor). Some individuals feels that having an independent Surveyor who is not acting for the Building Owner (The person carrying out the works) is the best option for them as they feel that the Surveyor will be acting for the interest of the neighbour.
  • Dissent but wish to use the same surveyor – As the wording states “same surveyor”, this basically means that you are content to use the surveyor that is being used by your neighbour. By choosing this option you shall now be using an Agreed Surveyor

There is another option which some surveyors do use and other surveyors do not use and this option is the consent subject to a schedule of condition being carried out.

  • Consent to the works subject to a schedule of condition being carried out will require a schedule of condition taking place prior to the works commencing – This means that you are more than happy for your neighbour to commence there works but would like a survey (Schedule of condition) carried out before the works commence. This option is a very cost effective option for your neighbour but at the same time covers any issues that may or may not arise in the future if damage was to occur from the works your neighbour is carrying out.
